The Meaning of FAPE in Special Education And Why It Matters

SOS for 2e welcomes for the first time Micki Moran from The Child & Family Law Center to discuss the legal implications of FAPE. The central question in every special education issue is whether the IEP or school program provides the student with a free, appropriate, public, education. The analysis of what constitutes a FAPE is at the heart of every IEP, every goal and in every special education attorney’s mind when there is a dispute. The term has been defined loosely by early court cases which are still used today as a yard stick to measure what the term means. However, in the current term the United States Supreme Court has agreed to review this issue in the Endrew F. Douglas County School District case. This case may be one of the most important special education cases in decades. In this presentation, Micki will share the facts of the case and a discussion of the legal issues and arguments and discuss how they matter to every parent and educator who works in the area of special education.
